Terms & Conditions

1.1 These General Terms and Conditions of Sale (GTC) apply to the offering and sale to consumers of the products marketed by P448 S.r.l. (Products) through the website www.p448.com, owned by P448 S.r.l. (Website). For the purposes of these GTC, a consumer is defined as a natural person who purchases Products from P448 S.r.l. (Seller) via the Website for purposes unrelated to their commercial, entrepreneurial, or professional activities (Customer).

2.1 The Products may only be purchased in the countries indicated on the Website.

2.2 The Products are intended for final consumers. Products may not be ordered by individuals or entities purchasing them for commercial purposes. In the case that such individuals or entities make any purchases of Products: (a) the Seller reserves the right to withdraw from the sales contract at any time, even after the delivery of the Products, and (b) the buyer will not be entitled to exercise the right of withdrawal nor the legal guarantee referred to, respectively, in Articles 6 and 7 of these GTC.

2.3 The Products are described in their essential features, and their description may be modified by the Seller at any time. The images of the Products may not accurately represent their actual appearance. Color or aesthetic variations may occur due to the resolution of the Customer's screen. Product descriptions and images are not contractual elements and do not bind the Seller.

2.4 The Products offered are available for purchase within the limits of available stock. If a Product becomes unavailable after the purchase, the Seller shall promptly notify the Customer, withdraw from the sales contract, and refund the purchase price. The Seller reserves the right to interrupt, temporarily suspend, or modify the offering of Products, in whole or in part, without prior notice.

2.5 Product prices are expressed in euros (€) and include VAT. The Seller reserves the right to change the price of the Products at any time without notice; however, the price applicable to the sale will be the one published at the time the order is placed.

2.6 The Seller may, at its discretion, determine and modify, at any time, the duration, methods, and pricing of sales, promotional offers, and special offers, in compliance with applicable laws.

3.1 The order is placed by the Customer through the completion of the guided procedure on the Website, which may require the Customer's registration, and the payment of the price. Submitting the order constitutes an irrevocable purchase proposal and implies the Customer's acceptance of these GTC. The sales contract is concluded when the Seller sends the Customer an order confirmation via email. These GTC are an integral part of the sales contract.

3.2 The Customer is responsible for ensuring the accuracy of the information provided at the time of registration and when submitting the order.

4.1 Payment of the price shall be made using the methods indicated on the Website.

4.2 Digital payments (e.g., credit card, debit card, PayPal, Apple Pay, Google Pay) through the Website are processed using systems that employ advanced security protocols to ensure the protection of the Customer's data.

4.3 The order will be processed after the Seller receives the payment. The Seller reserves the right to suspend the processing of the order until it verifies that the payment has been successfully completed.

5.1 The Products are shipped to the address provided by the Customer, according to the manners and timing of delivery indicated on the Website.

5.2 The Seller shall not be held liable for delivery delays caused by force majeure events, such as strikes, unfavorable weather conditions, pandemics, customs procedures, or unavailability of transportation. In the event of a delay attributable to the Seller that exceeds the legal time limit, the Customer is entitled to terminate the sales contract and obtain the refund of the price paid or agree to a new delivery date.

5.3 The risk of loss or damage to the Products passes to the Customer at the time of delivery. Upon delivery, the Customer must verify the integrity of the Products, including the packaging, and promptly report any visible damage or defects to the Seller.

5.4 Shipping costs are borne by either the Seller or the Customer, depending on what is indicated on the Website. In the case of shipments to non-EU countries, any customs duties, taxes, and other charges levied by the destination countries on the shipment or sale of the Products are the responsibility of the Customer.

6.1 The Customer has the right to withdraw from the sales contract without providing any reason within 14 (fourteen) days from the delivery of the Products. The Customer must exercise the right of withdrawal in accordance with the procedures indicated on the Website. In the event of withdrawal, the Customer must return the Products to the Seller within 14 (fourteen) days from the date the Customer notifies the Seller of its withdrawal, and the Seller will refund the price and any standard shipping costs paid by the Customer, excluding any costs for express delivery.

6.2 The Products must be returned in their entirety, including any tags, labels, and accessories, in their original packaging, undamaged and without having been used. The risk of loss or damage to the Products during the return shipment lies with the Customer until they are delivered to the Seller. Return shipping costs are borne by the Customer, unless otherwise specified on the Website.
6.3 The Seller will issue a refund within 14 (fourteen) days from the receipt of the Products, as returned in compliance with the provisions of paragraph 6.2. Where possible, the refund will be made using the same payment method used by the Customer.

7.1 The Products are covered by the legal guarantee of conformity provided for by Articles 128 to 135-septies of Legislative Decree 206/2005 ("Consumer Code") for a period of 24 (twenty-four) months from the date of delivery, within which the Customer must report any defects of conformity under penalty of forfeiture.

7.2 If the Seller finds that the Customer's claim regarding the defects of conformity has merits, it will authorize the return of the Products for inspection. Authorization for the return does not in any way constitute recognition of the defects of conformity. The risk of loss or damage to the Products during the return shipment is borne by the Customer until they are delivered to the Seller. The Seller will bear the return shipping costs.

7.3 If the Seller recognizes the existence of defects of conformity, the Customer may request, at its discretion, the repair or replacement of the Products, a price reduction, or the termination of the sales contract. In the case of termination of the contract, the Seller will refund the price and any standard shipping costs paid by the Customer, excluding any costs for express delivery. Where possible, the refund will be made using the same payment method used by the Customer.

7.4 The Seller shall not be held liable for any damage to the Products, the Customer, or third parties resulting from improper use, storage, and/or maintenance of the Products, or failure to follow the instructions provided by the Seller.

7.5 The Seller shall not, under any circumstances, be held liable for indirect and/or incidental damages to the Customer or third parties resulting from defects of conformity of the Products, except in case of the Seller’s wilful misconduct or gross negligence.

8.1 The contents of the Website, including but not limited to text, images, graphic design, and software, may be protected by copyright held by the Seller or third parties and is the exclusive property of the Seller or licensed to it. Users of the Website are strictly prohibited from reproducing, modifying, using, and/or circulating such contents by any means.

9.1 Sales contracts for the Products and these GTC are governed by Italian law, including the provisions of the Consumer Code.

10.1 The Seller reserves the right to amend these GTC at any time, without prior notice, by publishing the revised version on the Website. The amendments will take effect upon publication and will apply to orders placed after that date.
